No Dream Act

Amnesty is back.

Just three months after the Senate immigration bill met its well-deserved end, amnesty advocates in the U.S. Congress resumed their efforts. Recently, Senator Richard Durbin (D–IL) announced on the Senate floor his intention to offer the Development, Relief, and Edu­cation for Alien Minors (DREAM) Act as an amend­ment to the defense authorization bill.

The DREAM Act (S. 774) is a nightmare. It is a mas­sive amnesty that extends to the millions of illegal aliens who entered the United States before the age of 16. The illegal alien who applies for this amnesty is immediately rewarded with “conditional” lawful per­manent resident (green card) status, which can be converted to a non-conditional green card in short order. The alien can then use his newly acquired status to seek green cards for the parents who brought him in illegally in the first place. In this way, it is also a back­door amnesty for the millions of illegal aliens who brought their children with them to the United States.

Sounds innocent enough.

But get this:

This amnesty opens a wide path to citizen­ship for any alien who entered the country before the age of 16 and has been in the country for at least five years. The guiding notion seems to be “The longer you have violated federal law, the better.”

Beyond that, all the alien needs is a high school diploma or a GED earned in the United States. If he can persuade an institution of higher education in the United States—any community college, technical school, or college—to admit him, that will suffice. Any illegal alien who meets these con­ditions (or who can produce fraudulent papers indicating that he meets the conditions) gets immediate legal status in the form of a “condi­tional” green card good for six years, according to Section 4(a)(1).

It is important to recognize just how sweeping this amnesty is.

* There is no upper age limit. Any illegal alien can walk into a U.S. Customs and Immigration Ser­vices office and declare that he is eligible. For example, a 45 year old can claim that he illegally entered the United States 30 years ago at the age of 15. There is no requirement that the alien prove that he entered the United States at the claimed time by providing particular documents. The DREAM Act’s Section 4(a) merely requires him to “demonstrate” that he is eligible—which in practice could mean simply making a sworn statement to that effect. Thus, it is an invitation for just about every illegal alien to fraudulently claim the amnesty.

* The alien then has six years to adjust his status from a conditional green card holder to a non-conditional one. To do so, he need only complete two years of study at an institution of higher edu­cation. If the alien has already completed two years of study, he can convert to non-conditional status immediately (and use his green card as a platform to bring in family members). As an alternative to two years of study, he can enlist in the U.S. military and spend two years there. This provision allows Senator Durbin to claim that the DREAM Act is somehow germane to a defense authorization bill.

* An illegal alien who applies for the DREAM Act amnesty gets to count his years under “condi­tional” green card status toward the five years needed for citizenship. (Section 5(e)) On top of that, the illegal alien could claim “retroactive benefits” and start the clock running the day that the DREAM Act is enacted. (Section 6) In combi­nation, these two provisions put illegal aliens on a high-speed track to U.S. citizenship—moving from illegal alien to U.S. citizen in as little as five years. Lawfully present aliens, meanwhile, must follow a slower path to citizenship.

* It would be absurdly easy for just about any ille­gal alien—even one who does not qualify for the amnesty—to evade the law. According to Section 4(f) of the DREAM Act, once an alien files an application—any application, no matter how ridiculous—the federal government is prohib­ited from deporting him. Moreover, with few exceptions, federal officers are prohibited from either using information from the application to deport the alien or sharing that information with another federal agency, under threat of up to $10,000 fine. Thus, an alien’s admission that he has violated federal immigration law cannot be used against him—even if he never had any chance of qualifying for the DREAM Act amnesty in the first place.

Any illegal parasite can claim to be a student, young or older- one who graduated recently or obtained their GED; they would then be given a Green Card. Once an illegal gets that, they are no longer illegal. These people will sidestep the process and manage to do so with Congress’ blessing. All under the radar. This is a sneaky move on the part of Sen. Durbin and his cohorts.

Contact your elected officials and tell them NO DREAM ACT! Its amnesty.

    I oppose the DREAM Act and even posted on it at RedState today. Nonetheless, I don’t see how Rep Durbin’s sponsoring this bill (which has been around since 2001) meets the Constitutional definition of treason, nor why he should be subject to a military tribunal (since that is the only venue for a firing squad.

    Many americans like you oppose the dream act but on the other hand, many americans support it, they do because somehow they understand all we go through to get an education, we can’t get scholarships even though some of us were in the top 5% of our class. I am an illegal college student, I was brought here when I was a kid, I love this country I consider this my home because where i was born is a place I no longer remember. We don’t want to take anything from you on the contrary we want to help you build a stronger and richer nation by contributing not with labor in the fields or construction but with our knowledge. I am an illegal and I’m not a parasite, I don’t get help from the goverment, never been hospitalized or gotten food stamps the food I eat the clothes I wear and my education has been paid with a lot and I mean a lot of effort from me and my parents and if I am in college righ now is because I value the meaning of education. Please be humaine and stop spreading hatred.Let us dream of a better future and hope.

Illegal immigrants are not slaves held against their will in a country, but they willingly come across and ignore the U.S.’s sovereign sanctity and laws as if they’re entitled to cross the border at will. Then they want all the benefits of being a legal citizen without bothering to go through the process. And it has nothing to do with race. If we had Canadians and Western Europeans flooding our northern border, I’d feel exactly the same way.

    No my ignorant little parasites, illegal immigration does not benefit this country. Any country that cannot control the influx of individuals will soon find that it can not remain solvent nor sovereign. Foreign citizens do not make our laws nor should they be able to flaunt them. I have no problem with people from other countries wishing to immigrate here, just please get in line with the other and then actually bother to assimilate (ie; learn the damn language) instead of being catered to by all of the hyper-tolerant left.

    I welcome immigration, controlled and legal. You La Raza types want anarchy. And no.. you won’t win…. because if you do, this great country will begin to teeter closer to the brink and end up like that corrupt, poor country called Mexico…..

    And they need to GRADUATE community colleges or attend 4-YEAR UNIVERSITY for 2 years to apply (or that military service for “2 years”). Not to mention the fact that they need to go to/graduate from a U.S. High school or get a GED from here. Your run of the mill illegal immigrants can’t take advantage of that (for christ’s sake, they don’t even speak English). Trust me on this. A LOT of illegal immigrants do not fall under these guidelines. Durbin is right (for once) about this being “narrowly tailored”.

    These kids have done nothing wrong – they never made a conscious choice to cross the border. Most, if not all, of these kids don’t speak their native tongues, and the only thing they know is (surprise) America. Oh, and did I mention that these kids are often exceptionally smart and talented?

    How cruel can you be, Akbar? To these kids, America IS their home. They were raised here, grew up speaking English and learning American values, and the kids that are target of Dream Act have enough initiative, intelligence, and discipline to go beyond secondary education to become a better part of what in their eyes is their community.

    Their so-called “home country” is as foreign to them as they are to you and me. Most of these kids don’t even speak the language there or know the culture. If you take one of these kids and put him or her next to an American citizen, you won’t even be able to guess which one is illegal even after talking to them for a long time.

    By not passing the Dream Act, you are
    1. Completely CRUSHING these poor kids’ dreams, hopes and futures.
    2. Severely weakening American economic/technological competitiveness by voluntarily deporting some of our brightest.

    Not helping these kids out with Dream Act would be the stupidest thing we and our country could do.

If you said “Hey, mom and dad, I wanna live in England!”, would you be able to live in England? When you were 15, did you have the ability to hire immigration lawyers, fill out forms, and pay the fees? Oh, that’s right. When you’re a minor, your parents do that and make those choices for you.

    You have to GRADUATE from high school and GO TO COLLEGE to be qualified for the Dream Act. My God, do you people even read the text of the legislation?

    Of course not… if you’d read the actual legislation, how could you be opposed to it?

They’ve said they are always struggling because their parents can’t help them. And they have to go into separate classes to help them with English. Which MY tax dollars pay for!     James Madison stated correctly that the masses cant govern themselves due to their perfidious and disparaging dispositions. I respect your position about being against this,it is your constitutional right, but again as an ATTORNEY(I apologize for the missing E on the previous comment, before I get attack on that as well)there is not enough substantial arguments against the Dream Act or for that matter legalization of immigrants.
    To everyone in this room including for and against the Dream act, this is what makes the U.S an eminent nation worth respecting, so BAS I respect you for the reason that you are protecting this country, but note it is not your country, it is a nation for all reasonable man to think, and bring understanding and eradicate to this irrational, cruel, violent, plangent world we live in.

    Where is the justice? Why am I paying taxes for their kids to go to school? Why am I paying for their medical? Let me ask this….lets just say only 10 out of the millions were living in YOUR house, and your paying for their food, education, medical services, how long would it take you to kick them out of your house? They are cockaroaches in society. Leaching off and just crippling our system. I just don’t get why people don’t understand the word ILLEGAL. They need to all go back, apply to come here legally and then PAY TAXES ….oh and learn this nations language, so that they may be a worthy contribution.

    Congratulations on overcoming such adversities to achieve so much. Many illegal immigrants students I get to meet during my work (I work as an admissions officer) are simply amazing students, and some of the stories they tell me are both inspiring and tragic.

    Kids who can’t speak English OBVIOUSLY can’t graduate high school and go to college – consequently they are NOT qualified under the Dream Act. Kids who don’t do well in school OBVIOUSLY cannot go to college – consequently they are NOT qualified under the Dream Act.

    Read the legislation. The whole thing. Don’t have a knee-jerk response to the word “illegal immigrant”.

    Hey, I’m against general amnesty as you are. But the target population of Dream Act did not make a choice to cross the border. Once again, let me ask you. If you decided you wanted to live in England when you were 15, can you consciously choose that step and go to England to live? Or is it your parents?

    There were ZERO elements of choice for these kids. Have you ever met one? (and for the love of God, remember that if the kid can’t speak English and doesn’t do well in school, he or she CANNOT be covered by the Dream Act) My job allows me to meet hundreds of these kids, and despite the university I work for being very prestigious and selective, I find myself thinking many of these kids got a good chance at getting accepted. And really, trust me on this, you can’t tell if the student is illegal immigrant or not until you notice that he or she is fidgeting around the question “do you accept students without resident documentation?”. I’m happy to answer “As long as you graduate from a U.S. high school, and you know, few other things [pause for laughter] you can be accepted and even get financial aid.”

And yes those kids should suffer the consequences for their parents bad behavior. It is the same as if a legal citizen commits a crime, but in this case the legal citizen is incarcerated for some time…..their kids have to suffer an absent parent due to their bad judgement. Just as a parent who committed a crime sneaking into our country illegally. You tell me what is the difference?

    The differences, Janne, are these:

    1. You keep calling them criminals, but where is the action? Living? Existing? There weren’t any choices, hence there’s no crime committed by these kids. If I attach a mechanical device onto your arm that makes you pull triggers against your will and you shot somebody, you’re not guilty – you didn’t have a choice in the matter.

    2. In the example you provide, the parent’s crime (let’s say grand larceny, which is what illegal immigration really is, anyway) leads to kid’s suffering in the form of absence of parents. In the Dream Act case, kid’s suffering takes form in getting their life shattered by being forcefully removed from what is, for all intents and purposes, their home. What’s worse – “Hey, kid. Your dad’s in jail.” or “Hey, kid. Have fun living in the $h!thole, also known as Mexico.”

    3. Deportation is a form of governmental punishment, while parental absence is an unfortunate condition. So tell me, you actually think it’s justified that our government punish the innocent? You believe in “Inheritance of guilt”? You believe that kids should be punished for their parents’ crimes?

    4. “Living in Southern California”? So are you telling me you’ve met college-eligible illegal immigrant high schoolers by truckloads? Or are you just thinking about the day workers? Once again, READ THE ACTUAL LEGISLATION.

    This is your original quote. It implies that 1. Illegal immigrants are ruining southern California and 2. if you don’t live in Southern California, you don’t know how bad illegal immigrant problem is.

    My response was 1. general illegal immigrant problem ISN’T the issue (for the hundred and eighth time), quit deflecting with slogans. and 2. my hometown is Mesa, ARIZONA, where illegal immigrant problem is as severe as any region in Southern California.

    Honestly, what was your reading comprehension score in high school?

    And again I remark that behind your “PATRIOTISM” lies a immigrant foundation, whether legal or not. All human beings are immigrants to this nation, but if you are really are an American, as Abraham Lincoln stated that an American is not one who lives here the longest, but the one that believes in Justice, Equality, Opportunity and Freedom.
    And here is something you should reflect on, there are less American Citizens who know their history than you can imagine, and I hardly would call these people worthy of Citizenship.

    Another point to consider, is Hesiod the Greek Poet wrote in Days and Works, that a successful and prosperous nation is a nation that welcomes foreigners, the welcoming serves to provide security and protection of the nations resources and inhabitants.
    Furthermore, in the New York Times, there is an article about how a town in New Jersey is regretting for passing an ordinance that imposes penalties on homeowners and business for hiring and renting to “illegal authorities”. The town is in bankrupt due to the closing of business as well as the legal cost that it incurred during the process. It now overturned it and now is working to revitalize its town (in other words welcoming immigrants again)

    So here I presented my argument and if you wish to argue back please do your research and as JohnnyFaz eloquently states that “Don’t have a knee-jerk response to the word “illegal immigrant””.

    Folks it doesn’t matter at this time anymore. The Dream Act was removed from the Defense Bill today and perhaps it will be debated in November. Or not. Either way it has no chance of passing.

    The children of illegal immigrants are just one more victim of the criminal activity of their parents- the crime being entering the US ILLEGALLY. Of course it’s not their fault…as it’s not the fault of hard working ethical and honest AMERICAN citizens who are being asked to FOOT the bill the parents of ILLEGALS should be footing. Sorry I have no compassion on this. Why should we pay for our own kids education AS WELL AS ILLEGALS’ kids? We should not. And there are more than enough of us who have been heard.

    And if want statistics Cesar, just go online and look it up it is all over the internet. Such as shoplifting down 67.8% for the day and the LAPD reported 82% reduction in auto theft, 78% reduction in vandalism and tagging, , 48% in violent crime…..and so on!
    Got the statistics from SWITRS. Just look it up!

    if america was to depend on next generation of students to be America’s future..damn i dont know what fucked up future would america have!……the us standards as of now,aint even close to been in tops,as passing the DREAm ACT:the us standards will boost up dramatically and the economy will benefit in a large amount..do not be ignorant!!….without US “AMERICA” would not b SHIT…….
