Almost as bad as Yankees in Georgia..

A policy that recommends a high bail bond for felony suspects with immigration problems has sparked a debate between judges, who say it reduces the likelihood suspected offenders will flee, and defense lawyers, who say it unfairly targets Hispanics.

The policy, adopted by criminal state district judges in December 2006, came under attack in a letter from the 365-member Harris County Criminal Lawyers Association that was co-signed by lawyers from the local Mexican Consulate and civil rights groups.

The judges’ guidelines recommend a bond of $35,000 for those who previously have been deported or are undocumented. The suggested bond amount is second only to that for non-capital murder — $50,000 — among offenses for which bail is permitted.

“Although it may appear facially neutral, the policy cannot help but burden those individuals who have Hispanic surnames,” Patrick McCann, president of the lawyers group, wrote state District Judge Debbie Stricklin. “As such, we believe that the policy ultimately discriminates against the same citizens who are often least able to speak up for and defend themselves because of language and cultural barriers.”

While judges may not intend to discriminate against Hispanics, McCann noted, the “demographics of our region and the inner workings of the criminal justice system” contribute to that possibility. McCann argued that even suspects who are undocumented might have family or job ties in Texas that would minimize chances they would flee if released on bail.

It does not unfairly target Hispanics… WHO ARE HERE LEGALLY!! It targets those people who have broken the law by entering this country unlawfully, and THEN commit, allegedly, a FELONY. Boo-frickin-hoo. If Achmed does it, or Sven does it, or Bob LeClair, or Cheung-Li Dragonfist, it don’t matter, the law ain’t looking at their skin color or their language, it looks at their immigration status. And ofcourse it keeps ‘em from running back down to the Mexican border, where sanctuary from those evil, oppressive, American laws awaits, as many of non-Hispanic origin have also ran to escape prosecution.

Now Mr. McCann is probably right that the majority of people caught in this will be hispanic… because the majority of illegals down here in Texas happen to be hispanic.

Playing the race/victim card here just doesn’t work. That won’t stop them from putting it down on the table, but no one should buy it. If I were to look at the amount of white-collar crimes committed by “white males”, there would probably be substantially more of them than those committed by “minority males”. The demographics definitely lay with the “white males” being a major population in the business sector, so perhaps laws that cover white-collar crimes are being racially insensitive to them? Ridiculous. Ofcourse.

But when you’ve got a group of lawyers (bah… spit), allied with the Mexican government and “civil rights (AKA racist groups like La Raza and Aztlan)

What this law does is prevent them from running back to Mexico until the heat dies down, or until they can get into another state with whatever fake documents they can drudge up.

    It’s all about money. Nothing else…when the lawyers are involved. The race bait game has been used in this debate for years. We’re all racist you know- because we have issues with ILLEGALS. Bullshite. It’s not about race. I could care less if we were being infested with lilly white assed Irishmen…my issue is with the astronomical costs associated with maintaining these illegals…they drain the economy and take away jobs…they drive down wages while upping welfare expenses. No thanks.

    The bills far outweigh the benefits. Since I pay the bills….

    I would like to suggest one more provision. When anyone properly convicted cries racism, it is used as an aggravating circumstance during sentencing.
